Solidaritätszuschlag für 2020/21 verfassungsgemäß sowie Neuregelung ab 1.1.2023 für häusliches Arbeitszimmer & Home-Office-Pauschale

Mit dem Jahressteuergesetz 2022 wurden die Regelungen zum häuslichen Arbeitszimmer und zur Home-Office-Pauschale grundlegend überarbeitet. Es ergibt sich teilweise ein erweiterter Zugang zu diesen Regelungen und die ansetzbaren Beträge sind teilweise deutlich erweitert worden. Diese Möglichkeiten gilt es ab 2023 zu nutzen. Lange erwartet wurde die Entscheidung des Bundesfinanzhofs zur Frage der Verfassungsmäßigkeit der aktuellen Erhebung des Solidaritätszuschlags. Die Erhebung des Solidaritätszuschlags war in den Jahren 2020 und 2021 noch nicht verfassungswidrig, wie der BFH mit Urteil vom 17.1.2023 entschieden hat. Vermutlich wird diese Frage nun dem Bundesverfassungsgericht vorgelegt.

Steuererleichterungen für Photovoltaikanlagen & Inflationsausgleichsprämie

wir berichten u.a. über die durch das Jahressteuergesetz 2022 erfolgten steuerlichen Änderungen, insbesondere über die deutlichen Steuererleichterungen für Photovoltaikanlagen. Daneben sind Regelungen zur Besteuerung der Entlastung nach dem Erdgas-Wärme-Soforthilfegesetz eingeführt worden. Des Weiteren sind ab dem 1.1.2023 z.T. deutlich geänderte steuerliche Verpflegungs- und Übernachtungspauschalen bei Auslandsreisen zu beachten.

Verbesserungen steuerlicher Rahmenbedingungen & Entlastungsmaßnahmen

Der aktuelle Jahreswechsel wird eine Vielzahl an Verbesserungen der steuerlichen Rahmenbedingungen bringen, z.B. für den Betrieb kleinerer Photovoltaikanlagen, die Nutzung eines Arbeitszimmers bzw. der Home-Office-Pauschale und hinsichtlich des Einkommensteuertarifs. Weitere Entlastungen insbesondere für Gaskunden sind bereits in Kraft getreten bzw. kurz vor der Umsetzung. Dazu zählen die Absenkung des Umsatzsteuersatzes und die „Soforthilfe“ im Dezember.
Im betrieblichen Bereich gilt es v.a. den Belastungen durch die gestiegenen Energie- und andere Rohstoffpreise mit steuerlichen und bilanzpolitischen Möglichkeiten zu begegnen. Schließlich ist auf die Fristverlängerung für die Erklärungsabgabe bei der Grundsteuer hinzuweisen.
