Häusliches Arbeitszimmer & Home-Office-Pauschale

Ausführlich hat die Finanzverwaltung zur Neuregelung des Abzugs von Kosten eines häuslichen Arbeitszimmers bzw. der Home-Office-Pauschale Stellung genommen. Diese seit 1.1.2023 geltende Regelung hat einen deutlich ausgeweiteten Anwendungsbereich, bringt aber für manche Berufsgruppen auch eine andere Einstufung mit sich. Zu beachten sind die Nachweis-/Darlegungspflichten. Mit dem Wachstumschancengesetz sollen die Regelungen zu den steuerlichen Abschreibungen deutlich verbessert werden. So soll die degressive Abschreibung bereits für Anschaffungen/Herstellungen ab dem 1.10.2023 wieder gelten und es soll eine degressive Abschreibung für Wohngebäude eingeführt werden.

Die Finanzverwaltung erläutert in einem ausführlichen Anwendungsschreiben die Regeln zur Steuerbefreiung bei der Einkommensteuer für bestimmte Photovoltaikanlagen. Diese mit Wirkung bereits ab 2022 eingeführte Regelung kann gerade bei der Errichtung einer solchen Anlage auf dem privat genutzten Einfamilienhaus sehr attraktiv sein, da eine merkliche Entlastung von steuerlichen Pflichten erfolgt. Insbesondere bei der Abgrenzung der steuerlich begünstigten Anlagen sind verschiedene Aspekte zu beachten. Weiterhin hat der BFH die Nachweisanforderungen für Mieter bestätigt, die haushaltsnahe Dienstleistungen oder Handwerkerleistungen bei der Einkommensteuer geltend machen wollen. Mit der zum 1.7.2023 in Kraft getretenen Pflegereform kommen neue Pflichten auf Arbeitgeber zu. Die Höhe der Beiträge zur Pflegeversicherung hängt seit dem 1.7.2023 auch von der Zahl der Kinder bis 25 Jahren ab. Daher müssen für die Lohnabrechnung Daten hierzu bei den Arbeitnehmern abgefragt und entsprechend verarbeitet werden. In einer Sonderbeilage stellen wir steuerliche Aspekte zu dem aktuell sehr viel diskutierten Thema der energetischen Sanierung von Gebäuden dar. Sowohl die Vorgaben durch das neue Gebäudeenergiegesetz („Heizungsgesetz“) als auch die bevorstehenden Vorgaben der EU lassen insoweit kurz- bzw. mittelfristig Maßnahmen notwendig werden. Insoweit sollten auch die bestehenden steuerlichen Fördermöglichkeiten genutzt werden.
